Hindraf Makkal Sakti’s decision to revive its suit against the British government

GEORGE TOWN: An academic has hailed Hindraf Makkal Sakti’s decision to revive its suit against the British government, saying it will serve to draw domestic and international attention to the plight of Malaysian Indians.

“The success of the suit is not relevant; it is the intended message that matters,” said Azmi Sharom, who teaches law at Universiti Malaya.

The class action suit demands US$4 trillion in compensation for Malaysians descended from Indians whom the British brought to Malaysia as indentured labour. Hindraf claims that the British government, when it granted independence to Malaya, left the Indians without representation and at the mercy of Malay extremists.

Hindraf’s London-based chairman, P Waythamoorthy, originally filed the suit on Aug 31, 2007, but it stalled following a Malaysian clampdown on Hindraf that included the arrest of several lawyers under the Internal Security Act.

Waythamoorthy announced recently that he would file the suit again.

Hindraf’s lawyers in London told FMT that they needed more documents on the colonial period in Malaysia, kept by the British Foreign and Commonwealth Office (FCO). The movement’s chief legal counsel in London, Imran Khan, will head a three-man delegation to Malaysia next month on a fact-finding mission.

Azmi met Waythamoorthy in Bangkok last year during an international conference and they discussed the suit.

He told FMT he was aware that Waythamoorthy and his small team of researchers were working hard to obtain and study thousands of relevant documents in Britain’s archives.

“From my personal point of view, Hindraf has every right to file the case on behalf of all Malaysian Indians,” he said.

“It’s an incredible effort by an ordinary person to push the issues pertaining to a community’s plight into the international and domestic limelight.”

He dismissed suggestions by certain quarters, notably in Umno, that the suit would threaten Malay interests.

“The extremist, nationalist and right wing Malay elements have their right to talk about the so-called Malay supremacy,” he said.

“But we have our right to ignore them.”

Uthaya, you are tough fighter, nothing wrong in fighting for your race after all everyone in the world are bloody racist in the brain, from the PM to grass root every one in politics are bloody racial.

Can anyone deny this? Can the PM deny this racial matter....? I dare challenge him withdraw the status of Bumiputra & NEP to prove I am wrong. 1Malaysia is another eye wash not a policy at all.

We had MIC for 52 years and many believe MIC failed the Indians in this country. Some still believe MIC can be revived but how? MIC is tainted with rouge dictator politicians. So how?

We need to start again. It's going to be tough but when the tough gets going nothing can block it's way.

Uthaya, take some rest and get ready for the next chapter. We, Indians are far left behind, we need to race with races. We have to depend solely on our makkal sakthi supporters to make our day. We eill struggle, we will hit hard and we will make big...........

HINDRAF 18 Point demands remains, KP Samy and Raidu, pls stop 'behind scene' amendments Hindraf 18 Point Demands

“Who is the true warrior” ? (Poorata Waathi )

Mr. K.P. Samy in order to defend Datuk Subramaniam has succeeded in exposing to the entire nation the secret collusion of some who tried to compromise the 18 point demands of Hindraf.
Which is the truth Mr. K.P.Samy :-

The Hindraf 18 point demands which were carefully drafted without ‘fear or favour’ to portray, reflect and incorporate the true marginalisation and discrimination of the Indians in the past 50 years, which was presented openly to the Prime Minister at Putrajaya on 12/08/07, attended and witnessed by about 5000 people.
OR
The so called memo which was, altered, adjusted and modified thus compromising the true demands and grievances of the Indians that was apparently handed over to the Prime Minister ‘behind closed doors presumably’ at some point of time by Datuk Subramaniam .

Who gave these perpetrators the right to covertly manipulate the one and only Hindraf 18 point demands which since November 25th 2007 Rally, has been proven to be wholeheartedly accepted by Indians. Who is Raidu to act as coordinator when he clearly has no status to do so.

Who are the others who called themselves ‘Hindraf ’ who had conspired and schemed in this intrusion of the 18 point demands. Who are the so called established and reputable legal firm that assisted in this invasion. The Hindraf 18 point demands are not to be manipulated, it speaks the truth although unacceptable by some who have been compliant all the while.

The Federal Constitution of Malaysia that enshrines the rights of the people of this nation was battered and distorted to emphasise the special powers of a certain group but at the same time infringing and contravening the rights of many others. We will not allow a similar manipulation and violation to the Hindraf 18 Point Demands that we “Makkal Sakthi” are holding close to our hearts and working very hard to achieve.

Why an attempt to change the 18 point demands?
The Kg Medan incident did happen, just like many unanswered deaths in police custody and likewise issues. Why turn a blind eye on these issues? We have a right to know what actually took place. Any unlawful death has to be answerable. An inquiry will reveal the true nature of the incidence, unless of course the truth is unacceptable by some. It took us nearly 30 years to ask the questions on ‘Maika Holdings Funds” and yet no answers. We cannot wait another 50 years to demand an inquiry into Kg Medan issue, it’s now or never. If Datuk Subramaniam is indeed exceptional within the MIC he must show his support to the Indian community first by answering the much frequent and repeated question of what happened to the ‘Maika Holdings Funds’. Otherwise we have no choice but to keep believing MIC is no different from the Government when it comes to accountability and transparency, or even worse.

Asking for compensation instead for the victims, is shameful and degrading. Can any amount of money close the chapter (unanswered) on the Kg Medan incident or bring back the lost lives. Will it make any better the suffering of those injured and traumatised by the terrible incident. This compensation request seems to imply that “the Indians if thrown a few pennies will shut up”. It’s no longer the case, not after November 25th 2007 awakening.

Why the fear in questioning the Malay privileges. The Federal Constitution declares equality amongst it citizens. Didn’t we the Indians shed our blood for the independence of this country? Didn’t we work equally hard and contribute to the prosperity and development of this great nation? Are we lesser off people than others?. Why then are we still being told not to question the Malay privileges?. The fear and inhibitions of the Indians got washed off with ‘chemical laced water’ on November 25th 2007.

Yet again the Indians are being coerced not to question the Malay privileges. Exactly what the MIC ‘mandores’ have been doing the last 50 years.

On another point, why Mr. K.P.Samy do you wish to portray Datuk Subramaniam as
a hero behind the Hindraf struggle for the Indians when such recognition deservingly belongs to those incarcerated for upholding justice and the rights of the Indians and the people “Makkal Sakthi” who are the true heroes alongside the remarkable bravery of many uprising heroines.

If passing a memo ‘behind the scene’ to the PM and receiving promises from the PM “just before elections” indicates warriorship ‘Poorata Waathi’ then you are truly testing the intelligence of the Indians. I quote Uthaya’s words here “You can fool some Indians some of the time but you can’t fool all the Indians all of the time”. The support and efforts presumably by Datuk Subramaniam has to be seen to be believed, he should come forth and declare support for Hindraf and the 18 point demands. Until then there are many who will presume that he, like many others in MIC has his own interest to protect first.

How can we ever believe or trust Datuk Sri Samy Velu to be in dialogues with the government for the release of the Hindraf 5 leaders, when early upon the arrest he declared the PM to have done the right thing. What a contradiction ! Where is the truth here Mr. Samys ????

History shows there is only one person in ISA detention who had fought for Human Rights and the Indians vehemently without ‘fear or favour’ for many years now and continues to do so from within his cell. We believe the person who did not sign the so called secret document was P.Uthayakumar. He is a man of principles unwilling to compromise in the name of Indians. ‘Ondre solvar, ondre saivar’ ( his words are his actions) Even today he will not beg or negotiate for his release. “Who is the true Warrior (Poorata Waathi)” here????

Hindraf ‘Makkal Sakthi’ will follow this approach and through its chairman P.Waytha Moorthy, the Coordinators and Supporters the struggle will carry on.

Mr. K.P. Samy, you “or those behind you” have done a wonderful deed in bailing and supporting those detained after the rally. For this we truly appreciate your contribution towards the Indian struggle.

What ever said and done there is only one Hindarf “Makkal Sakthi” and one 18 Point Demands… not what took place “ BEHIND THE SCENES”.

“Makkal Sakthi” attempted meeting with Penang CM February 12, 2008









For those who could not understand what is going on in the above videos, well, approximately 300 Makkal Sakthi’s’ gathered at Komtar this morning in an attempt to meet Penang CM Koh Tsu Koon. They were not alone, as the current infamous “HINDRAF” child Vwaishnavi Waythamoorthy was together with them to hand over a memorandum and a bunch of roses to the CM.

The memo urges the Penang CM to intervene for the sake of ensuring the safety of crowd, as well as children, in which they would be gathering on 16th February 2008 to hand over “Valentine’s Day” roses to the Prime Minister and to seek justice for the five heroes detained at Kamunting.

To their despair, the CM did not showed up. Instead, one of his representatives came and acknowledged the documents.

ROYAL POLICE FORCE UNEASY WITH LARGE PRESENCE OF HINDRAF SUPPORTERS AT TAIPING HOSPITAL.

HINDRAF WOULD LAUNCH 1000 POLICE REPORTS AGAINST POLICE SHOULD UTHAYAKUMAR BE PREMATURELY DISCHARGED .

It has come to our attention the Police Special Branch is colluding and exerting pressure on doctors at Taiping Hospital to immediately discharge Uthayakumar from Hospital as they are “uneasy” with the large presence of HINDRAF supporters and steady flow of supporters throughout the day at Taiping Hospital.

25th and 26th January 2008 saw huge numbers of HINDRAF supporters holding candlelight vigil at the Hospital and hundreds of devotees held special prayers for Uthayakumar at most of the temples in Taiping vicinity.

We have received reliable insider information the Special branch officers are exerting pressure on Doctors to certify Uthayakumar is fit to be discharged despite doctors earlier informing Uthayakumar and his family members that he would be continuously monitored until he breaks his fast on Monday due to his health condition.

HINDRAF warns the Royal Police Force that we would have no choice but to lodge at least 1000 Police reports against the police should Uthayakumar be prematurely discharged and seek the urgent help of the International Red Cross to send a fact finding mission to Malaysia to assess the situation.

Pak Lah Should Sack Samy Vellu For Disgracing Malaysia In India

A Malaysian cabinet minister on official business in India was given short shrift by a provincial leader who declined to meet the Malaysian politician despite repeated requests. By shamelessly waiting at Chennai to be given the green signal for an ‘audience’ to meet Tamil Nadu Chief Minister M. Karunanidhi and having been humiliatingly snubbed on three occasions, Malaysia’s longest serving federal minister Datuk Seri S. Samy Vellu has brought disgrace to our country. It is an unprecedented and demeaning incident where a senior leader of our ruling party was made to wait hat in hand and finally shown the exit empty-handed, much to his embarrassment and great shame to the nation.

Why did Samy Vellu take it upon himself to ‘clarify’ matters pertaining to Malaysian Indian problems with so many leaders in India? Was it to ‘explain’ the issues as seen by our race-discrimination practising government? Or was it a futile and desperate attempt to mollify the Indian leadership and play down the real truth behind the hardship and injustice faced by Indians in our country?

That he was spurned by the Tamil Nadu CM is not surprising. The wily old fox in Chennai has very deep and close connections worldwide including Malaysia and knows exactly what has been going on and fully realises the culpability of Samy Vellu and the MIC. Already a successful politician in then Madras while Sam was still in Standard Six E, Karunanidhi is the epitome of the shrewd and cunning Indian politico who can be simultaneously benevolent and ruthless. He probably could smell bullshit wafting his way when Sam’s plane touched down at Chennai.

Now that Sam has made a complete fool of himself in India, the PM should sack him on his return. Not only has he shown the propensity to behave like an errand boy of the Indian leadership he has also in a way backstabbed our government by revealing that there was no proof of Hindraf’s terrorist links. In an indirect manner he has confirmed that our PM, Deputy PM, Attorney-General and Inspector-General of Police are all unconscionable opportunists and liars. (I didn’t mention Zainuddin Maidin’s name in the above list because everyone knows that he is an unconscionable opportunist and liar)

Samy Vellu has become a political liability at this crucial juncture when elections are said to be imminent. The Malays despise him, the Chinese can’t stand his arrogant demeanor and the Indians hate him. So why not make use of this opportunity and jettison this long overstaying, superfluous, burdensome and waning political power broker?

NEW DELHI: It was a volcano waiting to erupt and the Pravasi Bharatiya Diwas meet, which closed here on Wednesday, came as a godsend for many Indian expatriates in Malaysia to vent their feelings on what had gone "terribly wrong" with them in the south-east Asian nation.

As the Malaysian government went into a denial overdrive, insisting it never even imagined freezing recruitment of workers from India, the expatriates squarely blamed works minister Samy Vellu, part of the government for almost three decades now, for the "serious plight" of Indians, who constitute a substantial minority there. The burst came as several delegates from Malaysia, despite "the fear of being hounded" back home if their "identities became known", went on to detail "what was really happening" there.

The minister, also in Delhi for the convention, met PM Manmohan Singh, Congress chief Sonia Gandhi and foreign minister Pranab Mukherjee. Vellu, the only Indian in the cabinet, had on Tuesday denied reports on recruitment freeze, and Malaysia's home minister Radzi Sheikh Ahmad echoed his words on Wednesday.

"In the real sense, recruitment freeze is a non-issue. PIOs in Malaysia, down now to 8% of population, are being systematically persecuted and marginalized in several other ways. Vellu, who uses his Indian origin for cosmetic purposes, has actually supervised this discrimination over the years," a senior second-generation delegate told TOI . The government's main idea, he said, was to give priority to ethnic Malays and Bhumiputras, who constitute 60% of the population with special rights under the constitution, and the Indians were the most to suffer under the practice.

"Our economic rights are under serious threat. There is a clear design to establish the social supremacy of the ethnic majority, and the mismatch between the civil (common) and Shariat laws has come as a tool for the persecution of Indians. Islamisation is another way in which we are being marginalised," he said.

Another delegate said the discrimination began way back in 1969 when the country witnessed "race riots", adding that the "big change" in the recent past was that Indians had become more organised.

"That is why anti-government protests rocked Malaysia in November last year. Vellu has been part of the decision-making process in the government, and to maintain his monopoly, he did not let the strength of Indians in the cabinet rise to even two in the 1990s. The number of Chinese cabinet ministers went up to six from three," he said.

Vellu is the head of Malaysian Indian Congress (MIC) that supports the ruling Barisan Nasional coalition. The delegates said under the present electoral and constitutional system, politicians enjoy absolute powers so much so that even the judiciary was accountable to the executive and free operation of the media was a distant dream.

"Naturally, electoral and political reforms were a big demand during the recent agitation, but activists of Hindu Rights Action Force (Hindraf) were branded anti-nationals and there was a move to press charges of treason against them. We do not feel secure," the delegate explained.

The Indians' share in the national equity basket was steadily declining. "Malaysia has nearly 1.8 million Indians and only 40% of them constitute the middle or upper-middle classes. The rest is blue-collar labour force. If there is one Indian diaspora experiment that has really failed, it is Malaysia. Unfortunately, the world is being told a different story," another delegate said.

PoliceWatchMalaysia.com …. blocked and banned?

Well, it is confirmed that many websites including the website which monitors the movement and activities of HINDRAF (Hindu Rights Action Force), PoliceWatchMalaysia.com is banned.

Previously, the same blocking massacre had been carried out by Securities Commission (SC) and Malaysian Communication and Multimedia Commission (MCMC) in blocking access to illegal investment scam sites, and certainly, these operation is expanded to block PoliceWatchMalaysia site and the many other websites as well. I’m not sure what were the other websites that had been blocked but one thing for sure, we are losing our ‘freedom of speech’ in this cyberspace world! It's unbecoming of the Malaysian authorities under the BN government to silence the public.

One commenter suggested the usage of proxy to access those blocked sites, and I would suggest the same too. There are many type of proxies available on the net, one being free web-based proxy, free proxy server to be used with internet browsers, tunneling softwares such as HTTP-Tunnel and so on.
