PI retracts stunning statutory declaration

Private detective P Balasubramaniam today retracted his stunning statutory declaration which had linked Deputy Prime Minister Najib Abdul Razak to murdered Mongolian Altantuya Shaariibuu.


The said declaration also had claims that Najib had a sexual relationship with Altantuya and that he was the one who had introduced Altantuya to Abdul Razak Baginda.

Balasubramaniam said that he was forced to make the declaration under duress. At a press conference in a hotel in Kuala Lumpur this morning, he produced a new statutory declaration.

Missing from the new statutory declaration were references of Najib having a sexual relationship with Altantuya nor of Najib being the person who allegedly introduced Abdul Razak to the Mongolian woman.

Also with the PI this morning was his new lawyer. His other lawyer, Americk Sidhu, who was with him yesterday was unaware of the latest development. The press conference is still underway.

Yesterday Balasubramaniam made shocking revelations that he had heard from Abdul Razak himself on the links between Najib and Altantuya.

But today he said that he wanted to withdraw the first statutory declaration filed on July 1 and replace it with the new one which he revealed today.

"I wish to retract the first declaration. I was compelled to affirm the July 1 declaration under duress," he said. He however did not reveal who forced him to affirm the first declaration.

Balasubramaniam was hired by Abdul Razak to deal with Altantuya in 2006 when she started ‘harassing' the former head of think-tank and a close confidant of Najib.

KUALA LUMPUR: Americk Singh Sidhu, the lawyer who had prepared the first statutory declaration for private investigator P. Balasubramaniam, is convinced his client was intimidated to retract his declaration alleging the Deputy Prime Minister had a sexual relationship with Altantuya Shaariibuu.

He believed the private eye had been coerced "by either threats or promises as I can think of no other reason."

He stressed that his client had made the first sworn declaration voluntarily without duress.

He said he had first met Balasubramaniam two months ago at a restaurant where he was asked by the latter to help draft a formal document on the Altantuya case.

The sworn declaration was made over a period of one-and-half months in several meetings with Balasubramaniam lasting hours, he said.

"I had no reason to doubt that what Balasubramaniam told me was anything other the truth.

"I was under the impression that he was a trustworthy person and what he said was what he perceived with his own senses," he said Friday evening at a press conference at the PKR headquarters.

Also present was Americk's counsel Manjit Singh Dhillon and PKR vice-president R. Sivarasa.

On Thursday, Balasubramaniam said the police had omitted vital information about Datuk Seri Najib Tun Razak's relationship with the murdered Mongolian translator including the fact that she wanted a US$500,000 commission for helping secure a submarine deal in Paris.

The private eye hired by Abdul Razak Baginda also told the press conference on Thursday how after the murder, he had seen an SMS message to Razak purportedly from the deputy Prime Minister telling Razak "I am seeing the IGP at 11am today...matter will be solved...be cool." Americk said he was shocked that within 24 hours his client had engaged the services of another lawyer and made another statutory declaration swearing that the first one was untrue and that he had been forced to sign it.

"As I am familiar with the character of Mr Bala, having spent hours recording his statement, I am very sceptical that he signed the second statutory declaration of his own free will."

Americk said after the press conference at PKR's headquarters on Thursday, he left with Balasubramaniam for his office and noticed a number of calls to the private investigator's mobile went unanswered.

He said Balasubramaniam told him they were from the police, one of which was from ASP Tonny Lunggan, the investigating officer of the Altantuya murder case.

When Americk told him that it was all right to answer the call, he said Balasubramaniam then spoke to ASP Tonny and the call was very lively and jovial.

He said when Balasubramaniam left his office at 4.45pm, he thought the private eye was going to meet ASP Tonny after 6.30pm for some fish head curry.

"He was in very good spirits when he left. I was also of the impression that ASP Tonny wanted to congratulate him for what he had done," he said.

On why he did not advise his client about his personal safety, Americk retorted: "He was going to see the police. How much safer can you be?"

When reporters called Americk Friday morning about the second statutory declaration, Americk tried to reach his client but the latter could not be contacted, even up till Friday evening when the press conference was held.

Malaysia Najib Rejects Anwar Allegation as Diversion

July 4 (Bloomberg) -- Malaysia's Deputy Premier Najib Razak denied allegations that he had an affair with a woman before she was killed two years ago, calling them a ``desperate attempt'' by opposition leader Anwar Ibrahim to divert attention from charges he faces.

``Absolutely not,'' Najib told reporters at a press conference at his parliament office yesterday. ``I never, never met her at all.''

Anwar is being investigated by police for alleged homosexual relations, a crime in Malaysia. He had said earlier yesterday there was a conspiracy to cover up ``shocking'' evidence linking Najib to the slain woman and called for an inquiry.

The two politicians are vying to become Malaysia's next leader after the opposition made record gains in March elections. Prime Minister Abdullah Ahmad Badawi, rejecting calls to resign, has said he'll hand power to Najib sometime after the ruling party's annual meeting in December. Anwar has predicted that he'll woo enough lawmakers to topple the government before then.

Malaysia's key stock index tumbled as the market resumed trading today on concern rising political tension will hurt investments and curb economic growth. The Kuala Lumpur Composite Index fell for a sixth day, losing 2.6 percent, to 1,123.84 at 9:04 a.m. local time, headed for its biggest drop since March 10 and its longest losing streak since March 2007.

Malaysian police in the past week confirmed investigations of Najib and Anwar. Both have called the claims against them fabrications intended to destroy their political careers.

Trading Allegations

Anwar has accused Najib of involvement in trumping up false homosexual sodomy charges against him, and yesterday held a press conference with a private investigator who alleged the deputy premier had an affair with Altantuya Shaariibuu, a Mongolian interpreter who was 28 years old when she was killed in a bombing in 2006.

The investigator, Balasubramaniam Perumal, said he had worked for Abdul Razak Baginda, a political analyst who was once employed by Najib and is on trial for abetting Altantuya's slaying. Balasubramaniam said he told prosecuting officers and police investigating the killing about the alleged affair, but they removed references to Najib from his statement.

Balasubramaniam's allegation is ``a terrible lie, malicious, fabricated, defamatory, which is designed to tarnish my image,'' said Najib, who previously has denied involvement in the killing.

`Shocking' Information

Anwar said Balasubramaniam's ``information is shocking'' and called the alleged alteration of his statement ``suppression of evidence'' by the police and prosecuting officers. Deputy Inspector General of Police Ismail Omar said the investigator's statement would be looked into, state news agency Bernama reported.

Responding to Anwar's allegation that he was behind the sodomy case, Najib said he had met the opposition leader's accuser but otherwise denied involvement.

The accuser ``came to my house because he needed help and was so traumatized,'' Najib said of the 23-year-old man.

Anwar, who was fired as deputy prime minister a decade ago and jailed for sodomy, was freed in 2004 after that conviction was overturned. He rejects all the charges against him.

I, Balasubramaniam a/l Perumal ... do solemly and sincerely declare as follows:

1. I have been a police officer with the Royal Malaysian Police Force, having joined as a constable in 1981 attached to the police field force. I was then promoted to the rank of lance corporal and finally resigned from the police force in 1998 when I was with the Special Branch.

3. Sometime in June or July 2006, I was employed by Abdul Razak Baginda for a period of 10 days to look after him at his office at the Bangunan Getah Asli, Jalan Ampang between the hours of 8am to 5pm each working day as apparently he was experiencing disturbances from a third party.

4. I resigned from this job after 2½ days as I was not receiving any proper instructions.

5. I was however re-employed by Abdul Razak Baginda on the Oct 5, 2006 as he had apparently received a harassing phone call from a Chinese man calling himself ASP Tan who had threatened him to pay his debts. I later found out this gentleman was in fact a private investigator called Ang who was employed by a Mongolian woman called Altantuya Shaaribuu.

6. Abdul Razak Baginda was concerned that a person by the name of Altantuya Shaaribuu, a Mongolian woman, was behind this threat and that she would be arriving in Malaysia very soon to try and contact him.

7. Abdul Razak Baginda informed me that he was concerned by this as he had been advised that Altantuya Shaaribuu had been given some powers by a Mongolian `bomoh' and that he could never look her in the face because of this.

8. When I enquired as to who this Mongolian woman was, Abdul Razak Baginda informed me that she was a friend of his who had been introduced to him by a VIP and who asked him to look after her financially.

9. I advised him to lodge a police report concerning the threatening phone call he had received from the Chinese man known as ASP Tan but he refused to do so as he informed me there were some high-profile people involved.

10. Abdul Razak Baginda further told me that Altantuya Shaaribuu was a great liar and good in convincing people. She was supposed to have been very demanding financially and that he had even financed a property for her in Mongolia.

11. Abdul Razak Baginda then let me listen to some voice messages on his handphone asking him to pay what was due otherwise he would be harmed and his daughter harassed.

12. I was therefore supposed to protect his daughter Rowena as well.

13. On Oct 9, 2006 I received a phone call from Abdul Razak Baginda at about 9.30am informing me that Altantuya was in his office and he wanted me there immediately. As I was in the midst of a surveillance, I sent my assistant Suras to Abdul Razak Baginda's office and I followed a little later. Suras managed to control the situation and had persuaded Altantuya and her two friends to leave the premises. However Altantuya left a note written on some Hotel Malaya notepaper, in English, asking Abdul Razak Baginda to call her on her handphone (number given) and wrote down her room number as well.

14. Altantuya had introduced herself to Suras as `Aminah' and had informed Suras she was there to see her boyfriend Abdul Razak Baginda.

15. These three Mongolian girls however returned to Abdul Razak Baginda's office at the Bangunan Getah Asli, Jalan Ampang again, the next day at about 12 noon. They did not enter the building but again informed Suras that they wanted to meet Aminah's boyfriend, Abdul Razak Baginda.

16. On Oct 11, 2006, Aminah returned to Abdul Razak Baginda's office on her own and gave me a note to pass to him, which I did. Abdul Razak Baginda showed me the note which basically asked him to call her urgently.

17. I suggested to Abdul Razak Baginda that perhaps it may be wise to arrange for Aminah to be arrested if she harassed him further, but he declined as he felt she would have to return to Mongolia as soon as her cash ran out.

18. In the meantime, I had arranged for Suras to perform surveillance on Hotel Malaya to monitor the movements of these three Mongolian girls, but they recognised him. Apparently they become friends with Suras after that and he ended up spending a few nights in their hotel room.

19. When Abdul Razak Baginda discovered Suras was becoming close to Aminah he asked me to pull him out from Hotel Malaya.

20. On the Oct 14, 2006, Aminah turned up at Abdul Razak Baginda's house in Damansara Heights when I was not there. Abdul Razak Baginda called me on my handphone to inform me of this so I rushed back to his house. As I arrived, I noticed Aminah outside the front gates shouting "Razak, bastard, come out from the house". I tried to calm her down but couldn't, so I called the police who arrived in two patrol cars. I explained the situation to the police, who took her away to the Brickfields police station.

21. I followed the patrol cars to Brickfields police station in a taxi. I called Abdul Razak Baginda and his lawyer Dirren to lodge a police report but they refused.

22. When I was at the Brickfields police station, Aminah's own private investigator, one Mr Ang arrived and we had a discussion. I was told to deliver a demand to Abdul Razak Baginda for US$500,000 and three tickets to Mongolia, apparently as commission owed to Aminah from a deal in Paris.

23. As Aminah had calmed down at this stage, a policewoman at the Brickfields police station advised me to leave and settle the matter amicably.

24. I duly informed Abdul Razak Baginda of the demands Aminah had made and told him I was disappointed that no one wanted to back me up in lodging a police report. We had a long discussion about the situation when I expressed a desire to pull out of this assignment.

25. During this discussion and in an attempt to persuade me to continue my employment with him, Abdul Razak Baginda informed me that:

1) He had been introduced to Aminah by Najib Razak at a diamond exhibition in Singapore.

2) Najib Razak informed Abdul Razak Baginda that he had a sexual relationship with Aminah and that she was susceptible to anal intercourse.

3) Najib Razak wanted Abdul Razak Baginda to look after Aminah as he did not want her to harass him since he was now the deputy prime minister.

4) Najib Razak, Abdul Razak Baginda and Aminah had all been together at a dinner in Paris.

5) Aminah wanted money from him as she felt she was entitled to a US$500,000 commission on a submarine deal she assisted with in Paris.

26. On Oct 19, 2006, I arrived at Abdul Razak Baginda's house in Damansara Heights to begin my night duty. I had parked my car outside as usual. I saw a yellow Proton Perdana taxi pass by with three ladies inside, one of whom was Aminah. The taxi did a U-turn and stopped in front of the house where these ladies rolled down the window and wished me `Happy Deepavali'. The taxi then left.

27. About 20 minutes later the taxi returned with only Aminah in it. She got out of the taxi and walked towards me and started talking to me. I sent an SMS to Abdul Razak Baginda informing him "Aminah was here". I received an SMS from Razak instructing me "to delay her until my man comes".

28. Whist I was talking to Aminah, she informed me of the following:

1) That she met Abdul Razak Baginda in Singapore with Najib Razak.
2) That she had also met Abdul Razak Baginda and Najib Razak at a dinner in Paris.

3) That she was promised a sum of US$500,000.00 as commission for assisting in a submarine deal in Paris.

4) That Abdul Razak Baginda had bought her a house in Mongolia but her brother had refinanced it and she needed money to redeem it.

5) That her mother was ill and she needed money to pay for her treatment.

6) That Abdul Razak Baginda had married her in Korea as her mother is Korean whilst her father was a Mongolian/Chinese mix.

7) That if I wouldn't allow her to see Abdul Razak Baginda, would I be able to arrange for her to see Najib Razak.

29. After talking to Aminah for about 15 minutes, a red Proton Aeroback arrived with a woman and two men. I now know the woman to be lance corporal Rohaniza and the men, Azilah Hadri and Sirul Azahar. They were all in plainclothes. Azilah walked towards me while the other two stayed in the car.

30. Azilah asked me whether the woman was Aminah and I said "Yes". He then walked off and made a few calls on his handphone. After 10 minutes another vehicle, a blue Proton Saga, driven by a Malay man, passed by slowly. The drivers window had been wound down and the driver was looking at us.

31. Azilah then informed me they would be taking Aminah away. I informed Aminah they were arresting her. The other two persons then got out of the red Proton and exchanged seats so that lance corporal Rohaniza and Aminah were in the back while the two men were in the front. They drove off and that is the last I ever saw of Aminah.

32. Abdul Razak Baginda was not at home when all this occurred.

33. After Oct 19, 2006, I continued to work for Abdul Razak Baginda at his house in Damansara Heights from 7pm to 8am the next morning, as he had been receiving threatening text messages from a woman called `Amy' who was apparently `Aminah's' cousin in Mongolia.

34. On the night of Oct 20, 2006, both of Aminah's girlfriends turned up at Abdul Razak Baginda's house enquiring where Aminah was. I informed them she had been arrested the night before.

35. A couple of nights later, these two Mongolian girls, Mr Ang and another Mongolian girl called `Amy' turned up at Abdul Razak Baginda's house looking for Aminah as they appeared to be convinced she was being held in the house.

36. A commotion began so I called the police who arrived shortly thereafter in a patrol car. Another patrol car arrived a short while later in which was the investigating officer from the Dang Wangi police station who was in charge of the missing persons report lodged by one of the Mongolians girls, I believe was Amy.

37. I called Abdul Razak Baginda who was at home to inform him of the events taking place at his front gate. He then called DSP Musa Safri and called me back informing me that Musa Safri would be calling handphone and I was to pass the phone to the inspector from Dang Wangi police station.

38. I then received a call on my handphone from Musa Safri and duly handed the phone to the Dang Wangi inspector. The conversation lasted 3-4 minutes after which he told the girls to disperse and to go to see him the next day.

39. On or about Oct 24, 2006, Abdul Razak Baginda instructed me to accompany him to the Brickfields police station as he had been advised to lodge a police report about the harassment he was receiving from these Mongolian girls.

40. Before this, Amy had sent me an SMS informing me she was going to Thailand to lodge a report with the Mongolian consulate there regarding Aminah's disappearance. Apparently she had sent the same SMS to Abdul Razak Baginda. This is why he told me he had been advised to lodge a police report.

41. Abdul Razak Baginda informed me that DPS Musa Safri had introduced him to one DSP Idris, the head of the criminal division, Brickfields police station, and that Idris had referred him to ASP Tonny.

42. When Abdul Razak Baginda had lodged his police report at Brickfields police station, in front of ASP Tonny, he was asked to make a statement but he refused as he said he was leaving for overseas. He did however promise to prepare a statement and hand ASP Tonny a thumbdrive. I know that this was not done as ASP Tonny told me.

43. However ASP Tonny asked me the next day to provide my statement instead and so I did.

44. I stopped working for Abdul Razak Baginda on Oct 26, 2006 as this was the day he left for Hong Kong on his own.

45. In mid-November 2006, I received a phone call from ASP Tonny from the IPK Jalan Hang Tuah asking me to see him regarding Aminah's case. When I arrived there I was immediately arrested under Section 506 of the Penal Code for criminal intimidation.

46. I was then placed in the lock up and remanded for five days. On the third day, I was released on police bail.

47. At the end of November 2006, the D9 department of the IPK sent a detective to my house to escort me to the IPK Jalan Hang Tuah. When I arrived, I was told I was being arrested under Section 302 of the Penal Code for murder. I was put in the lock up and remanded for seven days.

48. I was transported to Bukit Aman where I was interrogated and questioned about an SMS I had received from Abdul Razak Baginda on Oct 19, 2006 which read "delay her until my man arrives". They had apparently retrieved this message from Abdul Razak Baginda's handphone.

49. They then proceeded to record my statement from 8.30 am to 6pm everyday for seven consecutive days. I told them all I knew including everything Abdul Razak Baginda and Aminah had told me about their relationships with Najib Razak but when I came to sign my statement, these details had been left out.

50. I have given evidence in the trial of Azilah, Sirul and Abdul Razak Baginda at the Shah Alam High Court. The prosecutor did not ask me any questions in respect of Aminah's relationship with Najib Razak or of the phone call I received from DSP Musa Safri, whom I believe was the ADC for Najib Razak and/or his wife.

51. On the day Abdul Razak Baginda was arrested, I was with him at his lawyers office at 6.30am. Abdul Razak Baginda informed us that he had sent Najib Razak an SMS the evening before as he refused to believe he was to be arrested, but had not received a response.

52. Shortly thereafter, at about 7.30am, Abdul Razak Baginda received an SMS from Najib Razak and showed, this message to both myself and his lawyer. This message read as follows: " I am seeing IGP at 11am today … matter will be solved … be cool".

53. I have been made to understand that Abdul Razak Baginda was arrested the same morning at his office in the Bangunan Getah Asli, Jalan Ampang.

54. The purpose of this Statutory declaration is to:

1) State my disappointment at the standard of investigations conducted by the authorities into the circumstances surrounding the murder of Altantuya Shaaribuu.

2) Bring to the notice of the relevant authorities the strong possibility that there are individuals other than the three accused who must have played a role in the murder of Altantuya Shaaribuu.

3) Persuade the relevant authorities to reopen their investigations into this case immediately so that any fresh evidence may be presented to the court prior to submissions at the end of the prosecutions case.

4) Emphasise the fact that having been a member of the Royal Malaysian Police Force for 17 years, I am absolutely certain no police officer would shoot someone in the head and blow up their body without receiving specific instructions from their superiors first.

5) Express my concern that should the defence not be called in the said murder trial, the accused, Azilah and Sirul will not have to swear on oath and testify as to the instructions they received and from whom they were given.

55. And I make this solemn declaration conscientiously believing the same be true and by virtue of the provisions of the Statutory Declaration Act 1960.

PKR Adviser Anwar Ibrahim's press statement on P Balasubramaniam' s shocking statutory declaration released at a press conference this morning.


Today we witness another episode of a consistent pattern of abuse of power and manipulation of the criminal justice system.

Recently one of the witnesses in the Altantuya trial approached us with detailed information of events connected to her disappearance and murder. The information was shocking.

Mr P Balasubramaniam, who was engaged by Abdul Razak Baginda as a private investigator was advised to seek legal counsel and document his story independently.

Today he is releasing a statutory declaration dated July 1, 2008 to the public, detailing the story that he has to tell about what actually happened and what was told to him by key personalities in this saga including Abdul Razak Baginda and Altantuya herself.

These revelations speak for themselves. They reveal, amongst others, the following allegations:

1. Mr Balasubramaniam was engaged by Abdul Razak Baginda to deal with alleged harassment by Altantuya in relation to debts owed to her (Paragraph 5 and 6).

2. Altantuya was promised a commission of USD 500,000 for assisting in a submarine deal in Paris (Paragraph 22, Paragraph 25.5 and Paragraph 28.2 and 28.3 ).

3. Altantuya was introduced to Razak Baginda by Najib Abduk Razak at a diamond exhibition in Singapore ( Paragraph 25.5 and Paragraph 28.1).

4. Altantuya, Najib and Razak Baginda had all been seen together at a dinner in Paris (Paragraph 28.2).

5. After the disappearance of Altantuya, a commotion took place in front of Razak Baginda's house several days after Dec 20, 2006 where girl friends of Altantuya and one Mr Ang (Altantuya's own private investigator) arrived searching for Altantuya.

Balasubramaniam had to call the police. A patrol car arrived shortly. Shortly thereafter an investigating officer from Dang Wangi police station who was handling the missing persons report lodged by one of Altantuya's girl friends arrived. Balasubramaniam then informed Razak Baginda who was at home to inform him of the events taking place at his front gate.

Razak then called one DSP Musa Safri who called him back informing him that Musa would be calling him on his handphone and that he was to pass the phone to the inspector from Dang Wangi Police station. Balasubramaniam then received the call from Musa Safri and duly passed the phone to the inspector.

After the conversation of three - four minutes, the inspector told the girls to disperse and to see him the next day (Paragraphs 34 - 38). We believe DSP Musa Safri was aide-de-camp to Najib at the material time.

6. Balasubramaniam was interrogated at Bukit Aman for seven consecutive days and his statement recorded at the end of November 2006. He says that he told the police all that he knew including everything Razak Baginda and Altantuya had told him about their relationships with Najib. These details were omitted from the statement he was asked to sign (Paragraph 49).

7. During the trial of Sirul, Azilah and Razak Baginda at the Shah Alam High Court, the prosecutor did not ask him any questions in respect of the relationship Altantuya had with Najib or of the phone call that he had received form DSP Musa Safri (Paragraph 50).

8. When Razak Baginda was arrested, Balasubramaniam was told by him that he had sent an SMS messsage to Najib the evening before (Paragraph 51). Razak also informed Balasubramaniam that he had received an SMS from Najib and showed it to him; the message read "I am seeing IGP at 11 A.M. today .... matter will be solved ... be cool".

Mr Balasubramaniam' s evidence also mentions the extent of the relationship between Altantuya and Najib. We are not interested in the personal nature of the relationship. That is entirely his own business and hers.

However the allegations revealed by him raise key questions of public interest:

a) Suppression of evidence by the police investigating officers and those responsible for prosecuting this case. Such suppression could only have happened with the full knowledge of top public officials such as the IGP and the AG.

b) The question is also raised as to whether such suppression of evidence was the reason behind the last minute switch in DPP's handling the case - where the head of the Criminal Division of the AG's Chambers, Yusuf Zainal Abiden was completely sidelined from the case leading him and the senior DPP originally slotted for the case Sallehudin Saidin to put in papers for early retirement some months later.

c) Questions can be raised now with regard to the sudden switching of the judge fixed to hear the case which took place in March 2007 - why was this really done?

d) Did Najib lie when he said that he had never met Altantuya before?

e) Did Najib lie when he said that he was not involved in any commission deals for the purchases of the Scorpene submarines"

Mr Balasubramaniam' s evidence vindicate what we have been saying all along; there has been no proper investigation of the murder of Altantuya and the investigation and proceedings in court seem to following a pre-arranged script for a pre-arranged outcome.

This has serious implications for the administration of justice in the country where the integrity and credibility of our key institutions such as the police, the AG's chambers and the judiciary are already severely tarnished.

Today's revelations further confirm a clear and consistent pattern of manipulation of the criminal justice system that we have witnessed in this country since 1998.

The allegations revealed here warrant a full royal commission of inquiry.

No more wasting time on point of order issue

THE brandishing of the ‘Blue Book’ – the Standing Orders – is now no longer allowed during the question and answer session as part of the measures by the Chair to “renew” Parliament.

Raising a point of order has lately become a “tool” by certain MPs to delay proceedings and get the attention of the Speaker.

Deputy Speaker Datuk Dr Wan Junaidi Tuanku Jaafar told Datuk Tajuddin Abdul Rahman (BN - Pasir Salak) this when the latter raised a point of order before the session got underway yesterday.

Tajuddin had claimed that Gobind Singh Deo (DAP - Puchong), who was expelled from the House by the Chair on Monday, had uttered remarks in the lobby disparaging Parliament and the Speaker.

“After discussions with the Speaker yesterday, we have decided that from now, we will no longer entertain any issue raised on the point of order during this session.

“All pertinent issues on this will now be brought forward to after the question and answer session,” he told the House.

However, he told Tajuddin that he would bring his argument to Speaker Tan Sri Pandikar Amin Mulia later.

The decision brought on a fiery protest from Fong Po Kuan (DAP - Batu Gajah), who demanded further explanation, arguing that this “was not a right move”.

“What if a MP brings up seditious remarks in the House or makes misleading statements?” she asked.

Dr Wan Junaidi pointed out that this was the practice in both the English and the New Zealand Parliaments.

“This is your opinion, Yang Berhormat. We have all read up on the matter more than you did. This is part of the measures of renewal in the Parliament we are trying to implement.

Later, Dr Wan Junaidi said the new measure was not aimed at stopping MPs from speaking.

“We just do not want to waste time on ‘point of order’.

“In the House of Commons, the Prime Minister can answer 13 questions in 30 minutes because there is no interference,” he said.

Kit Siang: How much ex-gratia paid to 1998 sacked judges?

LIM Kit Siang (DAP – Ipoh Timur) has asked the Government to reveal the amount of ex-gratia paid to a former Lord President and five Supreme Court judges, who were sacked during the 1998 judicial crisis.

Debating on the motion of the mid-term review of the Ninth Malaysia Plan, he questioned whether the ex-gratia was adequate. He also said that so far, no one knew how much were paid as the sum was never disclosed.

Lim also questioned the delay in the setting up of the judicial appointment commission and the Independent Police Complaints and Misconduct Commission (IPCMC).

“Reforms need to take place in the judiciary and the police.

So far, IPCMC has yet to be established and Datuk Seri Anwar Ibrahim does not have confidence in the police,” he said.

Lim also questioned the reason for the cancellation of the Monorial and Penang Outer Ring Road projects in Penang.

“The RM2.3bil projects are off. Is this the way to punish Penangites, who have chosen PKR and the DAP?

“Is this the Government that only rewards those who support Barisan Nasional and not all people in the country?” he asked.

He also said that the additional RM1bil given to Sabah would not solve the state’s problem.

“Sabah has been neglected for the past 44 years. Where can the RM1bil go? It will only benefit a few people in Sabah and not the rakyat,” Lim said.

KUALA LUMPUR: Malaysia will issue a protest letter to the US Embassy over the country’s statement on investigations into Datuk Seri Anwar Ibrahim’s case and said Washington should “get its facts right”.

Prime Minister Datuk Seri Abdullah Ahmad Badawi said he had instructed the Foreign Ministry to send the protest letter to the US Embassy.

“This is a statement which I perceive as an attempt to meddle in our administration. We have our own Government, our own laws and our own enforcement,” he told a press conference at Parliament House here yesterday after meeting up with PKR president Datin Seri Dr Wan Azizah Wan Ismail.

On Monday, foreign wires reported US State Department spokesman Tom Casey as saying the United States would oppose any politically motivated investigation or prosecution of Datuk Seri Anwar Ibrahim.

“The main point for us is that the rule of law needs to stand above politics,” Casey was quoted as saying in the statement, adding that the department “hoped there would not be a pattern” because Anwar had faced similar charges back in 1998.”

Abdullah said Malaysia knew how to ensure the law was implemented fairly and that nobody would be ill-treated or threatened.

He said the statement seemed to indicate that the country was prejudiced against the Malaysian Government and the enforcement of its laws.

He added that it was inappropriate for a country, which is one of Malaysia’s largest trading partners, to issue such a statement.

On PKR’s Bandar Baru-Kulim MP Zulkifli Nordin saying that the party had received intelligence from a neighbouring country of threats against Anwar, Abdullah said he should lodge a police report.

“Don’t merely speculate. I hope there won’t be anybody who will draw his own conclusion and fling accusations on this matter,” he said.

“Let the probe continue,” he said.

At another press conference, Deputy Prime Minister Datuk Seri Najib Tun Razak said Anwar’s case “was never politically motivated.”

“Washington had better get its facts right,” he said.

KUALA LUMPUR - A DAY after he was allegedly sexually assaulted by Anwar Ibrahim, opposition party worker Saiful Bukhari Azlan (left) reportedly sent him an email saying he was resigning because he felt that he was unqualified and lacked the discipline for the job.

The email - in which he said he arrived at the decision after much 'reflection and contemplation' - came a day before he lodged a police report against his former boss, online newspaper Malaysiakini said yesterday.

An e-mail believed to be from Mr Saiful was made available to Malaysiakini, in which he revealed his decision to quit.

The e-mail, dated June 27, was sent to Mr Anwar and Mr Ibrahim Yaacob, chief of staff of Parti Keadilan Rakyat (PKR), from Mr Saiful's Blackberry phone at 3.01am.

The content and receipt of the e-mail messages were confirmed to The Straits Times by PKR secretary-general Sallehuddin Hashim.

Mr Saiful made his police report last Saturday, saying he had been sexually attacked by Mr Anwar last Thursday.

In his e-mail message, he said he was quitting due to his lack of discipline, and that he was unqualified for the job.

'This is the conclusion from my reflections of myself.

'1. Indiscipline. Not punctual.

'2. Unqualified. It will make it easier for your enemies to attack you and tarnish your image.

'For the sake of your well-being and the party's, I regret to inform you that I am submitting my resignation as your private assistant effective today.

'Thank you for giving me the opportunity to work. All the knowledge that you've bestowed upon me will be used as best as possible.'

Mr Anwar sent him a reply in an e-mail just over three hours later, at 6.28am.

He wrote: 'Thank you for continuing your services and (good luck with) your university education.

'You have served with sincerity, loyalty and commitment. There is more knowledge to be gained. Haha.

'Ibrahim will coordinate your tasks after this as best as he can.'

By saying Mr Saiful would be 'continuing' his services and that Mr Ibrahim would 'coordinate your tasks after this', it is unclear if Mr Anwar meant the young man would serve in another capacity.

Mr Ibrahim said the e-mail address belongs to Mr Saiful. But he is sceptical as to whether the resignation letter was actually written by the man.

'I received that e-mail that day and I could tell that it is not his style. It could have been authored by somebody else,' he told Malaysiakini.

Malaysia's Anwar says he's victim of dirty conspiracy

Malaysia’s opposition leader Anwar Ibrahim, facing a fresh sodomy scandal, accused the national police chief and the attorney general Tuesday of fabricating evidence against him in his previous sodomy trial in 1998.

Anwar, who is seen by many as a future prime minister, filed formal complaints against Inspector General of Police Musa Hassan and Attorney General Abdul Gani Patail at a police station in Shah Alam, a Kuala Lumpur suburb.

He demanded an "immediate and transparent investigation" into the two officials, saying they are unlikely to be neutral while investigating the new sodomy accusation against him because of their alleged role in his old case.

The new allegation, made by a 23-year-old worker in his office, was part of a political conspiracy by the government to thwart his political career and to "cause anxiety and disgust among Muslims" against him, Anwar said to reporters.

Denying that he had any relations with the man, the 60-year-old Anwar said: "I can tell you this is a conspiracy. I have all the evidence and alibis to support me."

"This government and this leadership is under siege," Anwar said after filing the police report. "I would advise them to drop the case. It is frivolous. No way I am going to give them an easy route this time. I am going to fight every inch of the way. This is a second round of a dirty conspiracy," he said.

Musa was the investigating officer and Abdul Gani the senior prosecutor when Anwar was tried for allegedly sodomizing his driver and an aide while he was deputy prime minister and finance minister in 1998.

There are no laws against homosexuality in Muslim-majority Malaysia but sodomy, even if consensual, is punishable by up to 20 years in prison.

Anwar insists he was innocent and that he was framed because he challenged then-Prime Minister Mahathir Mohamad for power. Mahathir fired him when the sodomy accusation surfaced, and handed him over to police.

While in custody Anwar was beaten up by then police chief Rahim Noor. In his police complaint, Anwar said Musa and Abdul Gani fabricated a medical report to disprove that he was beaten up by Rahim - who later pleaded guilty.

The two officials were not immediately available for comment.

Malaysia’s highest court overturned the sodomy conviction in 2004. By then Anwar had formed an opposition party that, in coalition with two other parties, made spectacular gains in March 8 general elections.

The results left the ruling National Front coalition reeling with a thin 30-seat majority in the 222-member Parliament, its worst performance in its history. Anwar has claimed he can convince more than 30 National Front lawmakers to defect, which would topple Prime Minister Abdullah Ahmad Badawi’s government.

Abdullah’s government denies it is using dirty tactics against Anwar.

"There has never been political motivation at all. Never crossed our minds," Deputy Prime Minister Najib Razak said to reporters.

Although Anwar’s sodomy conviction was overturned, he could not free himself from a related abuse of power conviction, which resulted in him being banned from holding political office.

That ban expired in April, a month after the general elections were held. He can re-enter Parliament through a by-election if a colleague vacates his or her seat.

By law, Anwar has to be a lawmaker before he can take the prime ministers job.

Anwar said he had originally planned to announce on Tuesday details of where he will contest a by-election.

"This has been derailed for a few days" because of the sodomy accusation, he said.

Anwar is married to his Peoples Justice Party president, Azizah Ismail, who is a Member of Parliament. The couple has six children, including a daughter who also is a lawmaker.

We refer to the above matter and wish to register our protest that Indians are still being rejected for civil service jobs. The Inland Revenue Board for instance in the NST news report dated 23/6/08 at Page 25 that "fewer Indians applying for posts at Inland Revenue Board". This has been the excuse given over the last 50 years since independence for rejecting Indian applicants to civil service jobs.

The government to show sincerity must also start advertising for these jobs in all the three Tamil news papers and also the Finance Ministry and Public Services Department website. All the applicants names must then be put up in the Finance Ministry and the Public Service Department web site. Similarly the names and the positions applied by the successful applicants and the rejected applicants with their grades, qualifications etc must also be published in these web sites. This would show transparency and accountability which the current generation of Indians would expect otherwise we would no longer accept the standard form replies by the government that "there were no Indian applicants, Indians not interested etc.

The same practices of transparency and accountability should also apply for business license applications, PSD scholarships for local and overseas students, public university places, critical courses at public universities e.g. for medicine, engineering, biotechnology, pharmacy, dentistry etc with their grades and the rejected list with their grades, taxi permits, lorry permits, small and medium scale Industry loans, contracts, business opportunities etc. The people power movement "Makkal Sakthi" no longer accepts the standard excuses that the government policies are good but only that it’s implementation is weak which has been dished out year in and year out over the last 50 years.

We hereby call upon the end of racism and racial discrimination by the Malaysian government. To this effect we propose the formation of a serious and powerful Race Relations Commission and an Equal Opportunities Commission with unlimited funding, full investigative and prosecution powers and completely independent, which would deal with all cases of racial and religious discrimination and all cases of unequal treatment and unequal opportunities.

We have had enough of and grown tired of UMNO using the MIC to address the critical Indian issues which we have high lighted to your goodselves before on a piece meal and case by case base. We want a wholesome solution to these critical Indian problems which would reflect UMNO’s sincerity and credibility.

Anwar dan para penyokongnya meninggalkan bangunan IPKS jam 3.20 petang dan menuju ke ibu pejabat parti di Tropicana, Petaling Jaya.

Dalam sidang media itu juga, beliau sekali lagi menafikan dakwaan yang dibuat oleh Saiful tersebut dan mempunyai bukti kukuh dan alibi yang boleh mengaitkan tentang insiden berkenaan namun Anwar berkata beliau akan mendedahkan dakwaannya itu dalam masa terdekat.

"Saya ingin memberi amaran dan ingatan agar jangan sesiapa mengulangi konspirasi jahat ini," tegas di hadapan puluhan wartawan dalam dan luar negara. Image

Beliau juga menafikan Mohd Saiful seorang pegawai peribadinya dan akan menjelaskan pada jangka masa terdekat tentang tarikh dan tempat kejadian itu yang dikaitkan dengan beliau.

Raja Petra Kamarudin Raja Petra Kamarudin signed a false Statutory Declaration. So say the Attorney-General (AG) and Inspector-General of Police (IGP). And, for that, Raja Petra must be sent to jail for two years under Section 203 of the penal Code.

Okay, no problem, I can live with that. But for sure the AG and IGP will be in the next cell of the same block and they shall remain in jail longer than I will. You see; the AG and IGP fabricated evidence ten years ago, back in 1998. And the punishment for this is more than just two years jail. So, while I go in for two years, the AG and IGP will still be in jail long after I have been released and will be sitting in the Havana Club enjoying my Cuban cigar.

Some of you may by now be blur on what I am talking about so allow me to take you for a trip down memory lane. On the night of 20 September 1998, Anwar Ibrahim was arrested and taken to the Bukit Aman lockup. The then IGP, Rahim Noor, entered the lockup soon after that and beat Anwar up. Anwar was blindfolded and handcuffed when Rahim Noor beat him up.

The recently ‘retired’ Commercial Crime Division Director, Ramli Yusof -- who is currently on trial on trumped-up charges of corruption -- rushed into the lockup when he heard Anwar screaming in pain. He grabbed Rahim Noor and pulled him away to stop him from continuing to assault Anwar.

They then left the lockup with Anwar lying unconscious on the lockup floor, covered in blood and still blindfolded and handcuffed. Ramli suggested that they send Anwar to the hospital but Rahim Noor refused. Instead, Rahim Noor asked them to detain Anwar under the Internal Security Act so that no one can meet him for the next 60 days -- and therefore find out that Anwar had been beaten up.

The next morning, Ramli went to check on Anwar and he found the latter still unconscious and exactly where they had left him the night before -- bloody, blindfolded and handcuffed. Ramli again tried seeking Rahim Noor’s approval to send Anwar to hospital but his plea was declined. Ramli then asked for a doctor to come to Bukit Aman to attend to Anwar.

At first the police said that Anwar had beaten himself up. He not only beat himself up but he continued beating himself even after he had become unconscious. This is the special quality of Anwar who can remain conscious after becoming unconscious compared to Abdullah Ahmad Badawi who is always unconscious whenever he is conscious.

When the government realised that only 1% of Malaysians believed that Anwar beat himself up -- and continued beating himself up after he became unconscious -- they had no choice but to order an investigation. And the investigation confirmed that Rahim Noor had beaten up Anwar and that other senior police officers were also present to witness the beating.

Nevertheless, in spite of everyone in Bukit Aman having knowledge of what happened, the current AG and IGP -- who were both in Bukit Aman at that time and were fully aware that Rahim Noor had beaten Anwar -- fabricated a report that said Anwar was beaten up by a person or persons unknown. Later, of course, Rahim Noor confessed to the crime when he realised he can no longer cover up his evil deed and was sentenced to a mere two months jail, the same jail term for someone who steals a banana. (They let him out after only 40 days).

The AG and IGP fabricated evidence back in 1998 so they must now pay for this crime. No doubt that was ten years ago but the evidence has just surfaced. Yes, that’s right, a whistleblower has just come forward to reveal the secret that he/she has been keeping for the last ten years.

Well, as I said in my 18 June 2008 Statutory Declaration: “I have been reliably informed”. Take note of this new phase my friends from the legal fraternity: I have been reliably informed. And I have been reliably informed that the AG and IGP fabricated evidence back in 1998.

God, does this Havana cigar taste good…..puff…….

POLICE REPORT LODGED BY DATO’ SERI ANWAR IBRAHIM
I, Anwar bin Ibrahim, (NRIC No: 470810-07-5095) , hereby make the following police report based on information that I have recently received.1. This report is in relation to the investigation into the assault on me by the former IGP Tan Sri Rahim Noor on 20 September 1998. I believe Tan Sri Rahim Noor, after being prosecuted, pleaded guilty to the assault. I had lodged a police report in respect of the assault on 27.9.98.2. In relation to the investigation into the assault, I believe that the Investigating Officer ACP Mat Zain bin Ibrahim (now Datuk Mat Zain) had conducted a thorough investigation and prepared an investigation paper (“IP”) which was presented by October 1998 to the former Attorney General, Tan Sri Mokhtar Abdullah and his team which included the current Attorney General Tan Sri Gani Patail for further action.3. The said investigation paper concluded that Tan Sri Rahim Noor was the perpetrator of the assault on me. The said paper reached a conclusion after a thorough investigation which included medical reports by Hospital KL forensic specialists such as Dr. Ab. Halim Haji Mansar and Dr.Zahari bin Noor and statement from at least 60 witnesses. The medical reports concluded that the injury inflicted on me was consistent with an assault.4. Despite the contents of the Investigation paper and the medical reports already available, Tan Sri Mokhtar with the assistance of the current Attorney General, Tan Sri Gani Patail then obtained the services of another doctor whom I was informed to be one Dr. Abdul Rahman Yusof.5. Doctor Rahman in an undated and second report speaks of a “reconstruction of the scene” on 14 December 2008. I believe that this so-called reconstruction of the scene never happened.

6. It is an undisputable fact that Dr. Rahman’s reports in relation to the assault on me were done without actually even examining me at any time.

7. However, despite the IP and the already existing medical reports, Tan Sri Mokhtar in his press statement of 5 January 1999 appears to accept the views of Dr. Rahman on the so-called “inconsistencies” in the other medical reports by the doctors who actually physically examined me.

8. Tan Sri Mokhtar’s press statement also states that the investigation which had been carried out did not identify the person or persons responsible for my injuries. This is inconsistent with the IP which had already concluded by October 1998 that it was Rahim Noor who assaulted me. Tan Sri Mokhtar and his team therefore had willfully misled the public. As the police investigation done by Mat Zain had apparently not led to any conclusion, there was a public outcry and demand for a Royal Commission which was then set up. Tan Sri Mokhtar also made a false statement that the IP was submitted to him on 19.11.98. I believe that Tan Sri Gani Patail had full knowledge of the false contents of this press statement.

9. I believe Tan Sri Musa Hassan and Tan Sri Gani Patail were present in Bukit Aman on 20 September 1998 and knew about the assault by Tan Sri Rahim Noor on me. Tan Sri Musa and Tan Sri Gani further concealed the fact of the assault on me from the public until my black eye and injuries were revealed in court.

10. I believe both Tan Sri Musa and Tan Sri Gani Patail were actively involved in the procuring of the second undated report by Dr. Rahman which makes false and incredible conclusions such as “the pattern and nature of the injuries are not consistent with a direct blow”, “accidental nature of the injuries could not be ruled out” and “self-inflicted nature of the injury should be considered”. They gave the instructions to Dr. Rahman to proceed to write this second report and were acting under the direction and/or jointly with Tan Sri Mokhtar Abdullah.

11. These facts show that Tan Sri Musa Hassan, Tan Sri Gani Patail and SAC II Datuk Mat Zain bin Ibrahim (who, according to Dr. Rahman’s second report, accompanied him to the cell in Bukit Aman where I was detained and participated in the so-called reconstruction of the scene) conspired with Dr. Rahman to procure the production of this second report. This was done so that my police report of 27.9.98 in respect of the assault would be regarded as a false police report for which I could be charged, or at the very least, to damage my credibility, so as to affect my defence in the other criminal cases where I was charged for so-called “corruption” and sodomy to facilitate a conviction.

12. I wish to point out that Tan Sri Gani Patail was the senior prosecutor assisting Tan Sri Mokhtar in the prosecution against me. Tan Sri Musa Hassan was the Investigating Officer for my prosecution. I also believe, that in an unprecedented manner, an operation room specially for my prosecution was set up at Bukit Aman’s compound where all these individuals would meet regularly.

13. This is not the first time that allegations of fabricating evidence had surfaced in connection with Tan Sri Gani Patail. I am informed that in the Federal Court decision Zainur bin Zakaria v Public Prosecutor [2001] 3 MLJ, Steve Shim CJ in delivering his judgment pointed out that “… was he not justified, on a prima facie basis, in complaining that Tan Sri Gani Patail’s conduct at the meeting on 2.10.1998 was an attempt to get Nalla to fabricate evidence in order to perfect charges against him for other alleged sexual offences?” The references to “he” and “him” in that sentence are references to myself.

14. In relation to the above, I refer to the following documents which will be of assistance to the police:

a. The press statement by Tan Sri Mokhtar issued on 5.1.99.
b. The notes of proceedings in the report of the Royal Commission of the evidence of Dr. Rahman
c. The second undated report produced by Dr. Rahman exhibited in the Royal Commission report.

15. I call for a fresh investigation into the fabrication of evidence in this case which I am advised is an offence contrary to section 192 of the Penal Code punishable up to 7 years imprisonment. I ask that all the persons who are implicated in the procuring of this second report by Dr. Rahman i.e. Tan Sri Gani Patail, Tan Sri Musa Hassan, Dr. Rahman and Datuk Mat Zain bin Ibrahim be investigated thoroughly so that the truth is known and the offending individuals punished.

Upko slams Melaka CM

(Daily Express) - Upko Saturday criticised Umno Vice President and Melaka Chief Minister Datuk Seri Mohd Ali Rustam’s support for the demonstration staged in Tawau against SAPP MP Datuk Chua Soon Bui.

Its Deputy President Datuk Wilfred Bumburing questioned whether certain people had the privilege to demonstrate while others, for example like the Hindraf (Hindu Rights Action Force), cannot.

“Ali Rustam’s comment that he supported the demonstration in Tawau has set a precedent. Is he saying that in future if YBs defer in opinions, they are free to demonstrate?” he asked.

Bumburing, who is also Tuaran Member of Parliament, said Ali Rustam’s comment will give the licence to other BN component parties to demonstrate should they differ in opinions.

“We respect the opinions of those who demonstrate but it seems that double standards are being practised whereby some demonstrations like those held by Hindraf and Bersih are stopped by the police while others are allowed,” he said.

Bumburing said he understands the feelings of Umno but demonstrations should not be held for whatever reasons.

“For a senior leader like Ali Rustam to give his endorsement for a demo is unbecoming. He should not condone demonstrations and the Government should not be seen as having two sets of rules, that is, you can demonstrate if it is in our favour and can’t if you are not,” he said.

Bumburing was responding to Ali Rustam’s comment and support for last Tuesday’s demonstration staged by Umno members against SAPP in front of Chua’s office.

The demonstration came about following SAPP’s plan to support a no-confidence motion against Prime Minister Datuk Seri Abdullah Ahmad Badawi, who is also BN Chairman.

Anwar's Case: PM Gives Assurance On Safety For Everyone

KUALA LUMPUR, July 1 (Bernama) -- The government Tuesday gave an assurance on the safety of everyone linked to the allegation of sodomy involving Parti Keadilan Rakyat (PKR) advisor Datuk Seri Anwar Ibrahim.

Prime Minister Datuk Seri Abdullah Ahmad Badawi said the country's law would certainly be enforced to ensure the safety of everyone involved.

"That was what was said by (Datin Seri) Wan Azizah. She feels insecure. That's what they feel. But on the part of the government, we want to ensure that whoever is involved in the case, whether the complainant or the accused, will be safe and the law ensures their safety," he said.

He said this to reporters after a meeting with PKR president who is also Anwar's wife, Datin Seri Dr Wan Azizah Wan Ismail, at his office at Parliament House, here Tuesday.

Abdullah said that at the meeting, Dr Wan Azizah had informed him about the case involving her husband and had asked the government to ensure that her husband was safe and there would not be any cruelty in the investigation process.

Referring to Dr Wan Azizah's doubts about the role of Attorney-General Tan Sri Abdul Gani Patail and Inspector-General of Police Tan Sri Musa Hassan in investigating the latest case on Anwar, Abdullah said the matter did not arise.

"I wish to emphasise here that both of them (Abdul Gani dan Musa) are professionals, they have their respective tasks and responsibilities, (they) must know how to discharge their responsibilities properly and according to the law and will not cause anything to happen that will violate the law," he stressed.

Abdullah conceded that Wan Azizah had expressed her doubts following Abdul Gani's and Musa's involvement during the investigation on the sodomy case against Anwar in 1998.

At that time, Abdul Gani was the Senior Prosecutor while Musa was the Investigating Officer in the case.

Asked whether the two men would continue to be involved in the investigation on the PKR advisor, Abdullah said: "At the moment, I am not certain who will conduct the investigation, but what I know is the top police officer from the Criminal Division will head the investigation to be carried out".

Meanwhile, Abdullah pointed out that he would not interfere in the case to ensure that the investigation would proceed smoothly as he had confidence in the authorities.

Asked whether an investigation would be carried out on Abdul Gani and Musa following the police report by Anwar against the two Tuesday, Abdullah said it was the responsibility of the police to investigate if there was any basis in the report.

Anwar Tuesday made a police report on the falsification of the statement involving the assault on him by former Inspector-General of Police Tan Sri Abdul Rahim Noor while under police custody about 10 years ago.

The police report was lodged at the Selangor Contingent Police headquarters (IPK), in Shah Alam at about 3pm.

Asked on the allegation by the PKR leader that she received intelligence reports from a neighbouring country issuing a warning of a death threat on Anwar, Abdullah said if it was true, they should lodge a police report.

"If they have anything that concerns the safety of or a threat to Anwar, then they should lodge a genuine report with the police," he said.

Asked whether the death threat was an effort by the PKR to politicise the issue, Abdullah said: "Everything is possible. If there is no evidence or facts on the report, then it certainly can be considered as an attempt to politicise the issue."

Asked whether Wan Azizah had asked for the charge against Anwar to be dropped, Abdullah said he could not recall whether she had made the request.

"I don't recall she asked for that... what she did mention was that her husband be assured of safety and at the same time there should be no injustice caused to him," he said.

At the conclusion of the press conference, the Prime Minister again refuted that the Barisan Nasional government was involved in any political conspiracy against Anwar.

Perak BN, Umno apologise over ‘snake fable’ remark

IPOH, July 1 — Perak Umno and Barisan Nasional (BN) today officially tendered an open apology over a sensitive remark made by an assemblywoman in the state assembly last week.

The apology, made in a statement faxed to the media by the chairman of the Perak Umno liaison committee and Perak Barisan Nasional (BN) Datuk Seri Tajol Rosli Ghazali, reads: "The rash expression by YB Hamidah Osman is most regretted and Perak Umno and Perak BN hereby officially tender their apology to all quarters who have felt uneasy in the matter, particularly Indians.

"YB Hamidah Osman has retracted the expression uttered in the state assembly but, in the interest of maintaining cordial inter-racial relations, it is hoped that this statement expressing regret and offering an apology will be accepted with an open heart by all quarters.."


Hamidah, the assemblywoman for Sungai Rapat, had reportedly asked Speaker V. Sivakumar during the assembly sitting on Wednesday whether he agreed to disagree with the saying of whether a snake or an Indian man should be killed first.

Perak Umno liaison committee secretary Datuk Ramly Zahari said today Tajol Rosli had instructed that the statement of apology be issued through the media.

Hamidah has also openly apologised for having made the remark. Yesterday, Gopeng MIC division chief M. Krishnan urged all Indian organisations to accept Hamidah's apology and not play up the issue. — Bernama

STATUTORY DECLARATION

I, RAJA PETRA BIN RAJA KAMARUDIN (IC No: 500927-71-5257) , a Malaysian citizen of legal age residing at No. 5, Jalan BRP 5/5, BuKit Rahman Putra, 47000 Sungai Buloh, Selangor Darul Ehsan, do solemnly and sincerely affirm and say as follows:-

1. I have been reliably informed that between about 10 p.m. on 19th October 2006 and early hours of the following day, the night Altantuya Shaariibuu was murdered, three (3) other people were also present at the scene of the crime;

(a) Datin Seri Rosmah Mansor, wife of the Deputy Prime Minister of Malaysia, Dato’ Seri Najib Tun Razak

(b) Acting Colonel Aziz Buyong (then Lt. Col.) a C4 expert

(c) Acting Colonel Aziz’s wife, Norhayati (one of Rosmah’s ADC)

2. My informer states that Acting Colonel Aziz Buyong was the person who placed the C4 on various parts of Altantuya’s body while being witnessed by Datin Seri Rosmah Mansor and Norhayati.

3. I make this Statutory Declaration because I have been reliably informed about the involvement of these three people who have thus far not been implicated in the murder nor called as witnesses by the prosecution in the on going trial at the Shah Alam High Court. I also make this Statutory Declaration because I am aware that it is a crime not to reveal evidence that may help the police in its investigation of the crime.

4. I have further been reliably informed that Prime Minister, Dato Seri Abdullah Ahmad Badawi has received a written report from the Military Intelligence confirming what I have revealed above and that the report was subsequently handed over to his son-in-law, Khairy Jamaluddin, for safe-keeping.

5. I have also been reliably informed that one of the Rulers has been briefed about this matter and His Highness is fully aware of what I have revealed above.

6. I have knowledge of who has informed me of this matter plus I have knowledge of the Ruler who has been briefed and is aware of the matter but I have agreed that I shall not reveal this information other than mention that the Prime Minister and his son-in-law have been handed a written report confirming what I have revealed.

7. The purpose of this Statutory Declaration is to urge all these parties who have been duly informed and have knowledge of this matter to come forward to reveal the truth so that the police are able to conduct a proper and thorough investigation into the murder of Altantuya Shaariibuu.

And I make this solemn declaration conscientiously believing the same to be true and by virtue of the provisions of the Statutory Declaration Act, 1960.

The Umno State Assemblywoman from Sungai Rapat, Hamidah Osman,
revealed the attitude of these Umno women last week when she
insinuated that if you see an Indian and a snake, you kill the
Indian first. Yes, that is what she meant.

"The police are the ones who will determine whether the report is
true or not. It is not something that we can determine. He will
definitely deny it. That is common for someone who has been
accused," said Prime Minister Abdullah Ahmad Badawi.

No, Abdullah Badawi was not talking about the people named in the
Statutory Declaration (read it here). He was referring to the latest
sodomy allegation against Anwar Ibrahim. "He will definitely deny
it. That is common for someone who has been accused." Yes, but is
this common only to Anwar Ibrahim? Would not Abdullah Badawi, his
son-in-law, Najib, Rosmah, Col. Aziz and Col Norhayati not also do
the `common' thing and also deny what was alleged in the Statutory
Declaration?

Thus far, everyone named in that Statutory Declaration has denied
what has been alleged. But, as Abdullah Badawi said, "He will
definitely deny it. That is common for someone who has been
accused." And, as Abdullah Badawi further said, "The police are the
ones who will determine whether the report is true or not. It is not
something that we can determine."

Hmm….but did not Abdullah Badawi also say last week that he believes
his Deputy Prime Minister Rosmah Mansor and her husband, Najib, are
innocent? Well, he said this at least as far as Rosmah and her
husband are concerned. But when it comes to Anwar Ibrahim he
says, "The police are the ones who will determine whether the report
is true or not. It is not something that we can determine. He will
definitely deny it. That is common for someone who has been accused."

Why did Abdullah Badawi open his mouth and profess Rosmah's and
Najib's innocence even before the police started their
investigation? Will the police now dare announce the opposite to
what Abdullah Badawi said, thus embarrassing the Prime Minister and
making him a liar, at worse, or stupid, at best?

Abdullah Badawi has already `locked' the police investigation and
this will force the police to arrive at only one verdict. It is now
impossible for the police to rule any other way other than declaring
that the Statutory Declaration is false. That would be the only way
to save the Prime Minister's face and insulate him from controversy,
or worse, from criminal charges.

In fact, the move to declare the Statutory Declaration false started
very early in the day. The Statutory Declaration was signed on
Wednesday, 18 June 2008, and handed to the prosecutors in the
Altantuya murder trial the following day. On Friday, 20 June 2008,
the Attorney-General lodged a police report on the basis that I had
made a false declaration.

How did the Attorney-General know it is false? Again, the Attorney-
General `locked' the police. Since the police report was based on a
false declaration and since the Attorney-General has said thus, the
police will now have to concur or else the Attorney-General too
would lose face.

We must remember that even before the Altantuya murder trial started
the Attorney-General had announced that only three people and no
others are involved in the murder. The Attorney-General had pre-
judged the case and effectively `locked' the judge. If evidence
surfaces in the course of the trial which points to the possibility
that more than three people are involved, the Attorney-General would
look very stupid and would probably open himself to allegations of
trial-rigging, which is a criminal act.

But then this will not be the first time that the Inspector General
of Police and the Attorney-General have been accused of trial-
rigging. According to Anwar Ibrahim, he has evidence that the
Inspector General of Police and the Attorney-General had fabricated
evidence during his 1998-1999 trials. In 1998, the Inspector General
of Police and Attorney-General were the investigating officer and
prosecutor respectively. Anwar was about to give this evidence to
Malaysia Today so that we can expose it when, suddenly, the latest
sodomy allegation exploded. Is this fantastic timing and a mere
coincidence or something more sinister?

Have no fear, Malaysia Today is here, and once we get our hands on
the evidence we will certainly reveal it to prove that the Inspector
General of Police and Attorney-General conspired to fabricate
evidence in Anwar Ibrahim's 1998-1999 trials -- unless they get
Anwar or me first of course. Anyway, if anything happens to Anwar or
me then you will know why we were silenced. But the evidence will
definitely not be silenced. It will still surface, with or without
Anwar or me. And let the conspirators beware because they will have
to face the wrath of the people.

So, I have signed a false Statutory Declaration, have I? Well, then
prove it because the onus is on the accuser to prove guilt and not
on the accused to prove innocence. And since they made a police
report and announced that I had made a false declaration even before
launching the investigation, this points to the very strong
possibility that the police investigation must `support' what they
have said, that I had signed a false declaration. To do otherwise
would be suicide, for them of course.

In the meantime, while they figure out how they are going to bring
me down and lock me away in the Kajang Prison, I too am working on
the evidence that will prove the Inspector General of Police and
Attorney-General fabricated evidence in Anwar Ibrahim's 1998-1999
trials. Let's see whether they get me first before I get them.
Anyone want to make a small wager that I will get them before they
get me? This should be an interesting bet don't you think?

Ooooh….I just love impossible odds. Anyway, while we wait to see who
gets whom first, let us look at another subject matter. This was
what happened in the Perak State Assembly last week as reported by
The Star on Friday:

The first 36 minutes of Question Time yesterday saw opposition
assemblymen continuously standing up and asking him for the chance
to speak, and raise issues.

One by Hamidah Osman (BN-Sungai Rapat) particularly earned the wrath
of the Pakatan Rakyat assemblymen when she asked whether
Sivakumar "agreed to disagree" with the well-known fable of whether
a snake or a man from a certain racial community should be killed
first.

Nga Kor Ming (DAP-Pantai Remis) and other Pakatan assemblymen
demanded Hamidah retract her words but she maintained she was merely
asking if Sivakumar "agreed to disagree" with it.

Sivakumar let her off with a warning and told her not to bring up
anything sensitive. Barisan whip Datuk Seri Mohamad Tajol Rosli
Ghazali (BN-Pengkalan Hulu) then asked her to retract her words, and
she did.

This reminds me of the statement by the Kampong Medan Umno State
Assemblywoman soon after the race riots of almost a decade ago,
which saw the loss of a number of lives. She said that the Indians
had it coming because they have been arrogant for far too long.

I was shocked when I read the newspaper report quoting this Umno
State Assemblywoman. Was she trying to say that it is not wrong to
kill Indians because they deserve it and were asking for it? Hell,
she is a State Assemblywoman and this is no way for a State
Assemblywoman to talk. Endorsing killings of Malaysians, even if
they are not of your race but are of another race, is just not on.
Even if they are not Malaysians but are illegal immigrants that is
still no reason to slaughter them and say that they deserve it.

Why are Malays so worked up and angry about Israeli soldiers killing
Palestinian civilians? Palestinians are not Malaysians. They are not
even Malays. So why poke our nose into something that is happening
so far away in a land we have never visited and to people we have
never met? If we have no sympathy for non-Malays killed in our own
country why are we so nosy-parker about the same thing in a far away
land?

The Umno State Assemblywoman from Sungai Rapat, Hamidah Osman,
revealed the attitude of these Umno women last week when she
insinuated that if you see an Indian and a snake, you kill the
Indian first. Yes, that is what she meant. Hey, fuck you; Raja Petra
Kamarudin is not seditious. This Umno State Assemblywoman from
Sungai Rapat and that other Umno State Assemblywoman from Kampong
Medan (now retired), who both endorse the killings of Indians, are.
Go for their balls (metaphorically speaking of course since they do
not actually have any). Leave mine alone. My wife has grown attached
to them and she would hate to see the government take them away from
her for the next couple of years.
